By accessing or using ATLANTIKA Technologies Inc. (“ATLANTIKA”) services, you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
These Terms constitute a legally binding agreement between you (either an individual or entity) and ATLANTIKA. By using our services, you represent that you have the authority to bind yourself or the entity you represent to these Terms.

- Continuous security monitoring and threat detection

Virtual CISO Services

Managed Security Services
- Firewall and intrusion prevention management

3. Use Restrictions
You agree not to:
- Use our services for any unlawful purpose or in violation of any regulations
- Attempt to gain unauthorized access to our systems or client data
- Interfere with or disrupt the integrity or performance of our services
- Reverse engineer, decompile, or disassemble any portion of our services
- Use our services to transmit malware, viruses, or malicious code
- Engage in any activity that could damage our reputation or business
- Resell or redistribute our services without written authorization
- Use automated systems or software to extract data from our services
4. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use of your account
- Ensuring all registration information is accurate and current
- Complying with all security protocols and procedures
- Properly configuring and maintaining systems that interface with our services
ATLANTIKA reserves the right to suspend or terminate accounts that violate these Terms or pose a security risk.
5. Fees and Payment
Payment Terms
- All fees are due according to the payment schedule in your service agreement
- Payments are non-refundable unless otherwise specified
- Late payments may incur interest at 1.5% per month or the maximum allowed by law
- You are responsible for all taxes, excluding those based on ATLANTIKA's income
Service Suspension
ATLANTIKA may suspend services for accounts more than 30 days past due. Suspended services will be reinstated upon payment of all outstanding amounts.
6. Intellectual Property
ATLANTIKA Property
All intellectual property rights in our services, including software, methodologies, reports, and documentation, remain the exclusive property of ATLANTIKA. You receive only a limited, non-exclusive, non-transferable right to use our services during the term of your agreement.
Client Data
You retain all rights to your data. By using our services, you grant ATLANTIKA a limited license to process your data solely for the purpose of providing services. We will not use your data for any other purpose without your consent.
Feedback
Any feedback, suggestions, or improvements you provide may be used by ATLANTIKA without obligation or compensation to you.
7. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the course of the service relationship. This includes:
- Security vulnerabilities and incident details
- Business strategies and operations
- Technical specifications and configurations
- Pricing and financial information
This confidentiality obligation survives termination of the service agreement for a period of five (5) years.
8. Warranties and Disclaimers
Service Warranty
ATLANTIKA warrants that services will be performed in a professional and workmanlike manner consistent with industry standards. Our sole obligation for breach of this warranty is to re-perform the deficient services.
Disclaimers
EXCEPT AS EXPRESSLY PROVIDED, SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. ATLANTIKA DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
ATLANTIKA does not guarantee that services will prevent all security breaches or detect all threats. Cybersecurity is a shared responsibility, and no system is completely secure.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- ATLANTIKA's total liability shall not exceed the fees paid in the twelve (12) months preceding the claim
- ATLANTIKA shall not be liable for indirect, incidental, special, or consequential damages
- ATLANTIKA shall not be liable for lost profits, data loss, or business interruption
- These limitations apply regardless of the theory of liability
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless ATLANTIKA, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your use of our services
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
- Any content or data you provide to us
11. Termination
Termination by Either Party
Either party may terminate services according to the terms specified in the service agreement. Standard notice period is 30 days unless otherwise specified.
Termination for Cause
ATLANTIKA may immediately terminate services if you:
- Breach these Terms or the service agreement
- Fail to pay fees when due
- Engage in illegal or unethical activities
- Pose a security risk to our systems or other clients
Effect of Termination
Upon termination, you must cease all use of our services and return or destroy all confidential information. Provisions that by their nature should survive termination will continue to apply.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida.
Both parties waive any right to a jury trial in any proceeding arising out of these Terms.
13. Changes to Terms
ATLANTIKA reserves the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Sending email notification to registered users
- Providing notice through our service portal
Continued use of our services after changes constitutes acceptance of the modified Terms.
